Although it is widely believed that Apple refuses to license its patents to competing companies, it turns out that’s a huge misconception. In fact, the company licenses a patent covering iOS touch-based scrolling to the likes of IBM and Nokia, and it offered the same deal to rival Samsung, who wasn’t at all interested. If it had taken Apple up on the offer, however, it could have spared the Korean company a whole load of trouble in court.

HTC, the world’s largest maker of Android phones, is in all likelihood furiously rubbing rabbit’s feet and sweating buckets in the face of a potential trade ruling Tuesday that could slam the door on U.S. sales of all handsets using the Google mobile operating system. Experts already predict Android is in “serious trouble.”

Just a day after the injunction against the Samsung Galaxy Tab 10.1 was lifted in Australia, allowing Samsung to sell the device down under for the first time, Apple has won a one-week extension that will once again put the tablet’s launch on hold while it prepares its appeal to the High Court.

With the recent controversy surrounding Carrier IQ, U.S. Senator Al Franken has jumped back into the fight for privacy and sent an open letter yesterday to Carrier IQ asking the company to answer a number of questions concerning the company’s key-logger and data logging software. Senator Franken’s letter contains 11 pointed questions mostly asking why the company logs information, what type of information they’re tracking, who receives the information, and how is it used?

Carrier IQ’s software is currently running on millions of smartphones in the U.S. Apple released a statement on Thursday promising to eradicate all traces of Carrier IQ’s software with a new software update. Android manufacturer HTC released a statement today blaming carriers for the inclusion of CarrierIQ on their phones. Samsung also released a similar statement.

Carrier IQ’s not having a good day. The invasive keylogging software which comes installed on over 140 million Android, Nokia and Blackberry smartphones is embroiled in controversy, and it’s not just creepy… it’s probably illegal, and Senator Al Franken — who once grilled Apple over the so-called LocationGate — is now demanding answers.

The Carrier IQ scandal has broken everywhere since we first reported it yesterday morning. The invasive rootkit is installed on over 140 million phones the world over, and logs everything you do with your device, from the numbers you dial to the smutty pictures you send to your girlfriend.

Yesterday, we reported the story as one proving Steve Jobs right about how Android tracks everything you do, but a day later, things seem a lot less black and white. Carrier IQ’s software comes pre-installed on other devices besides Android, like BlackBerrys and Nokias, and as even the name of the software suggests, seems to be something installed by carriers. And, as it turns out, some iPhones. Luckily, disabling it is the easiest thing in the world, and it logs none of your personal information, unlike the software’s more nefarious Android counterpart.

Here comes more evidence Amazon’s $199 Kindle Fire tablet is Apple’s first serious rival in a tablet war so far strewn with the corpses of the iPad’s Android-based victims. In the first skirmish between the two tablets, the Kindle Fire is outselling the 16GB iPad on Best Buy’s website.

Not even the threat of costly early-termination fees are enough to keep many consumers from jumping ship for the newest iPhone. Some 45 percent of cell phone owners have broken their carrier’s contract in order to grab Apple’s iconic smartphone, according to a new survey showing just how loyal many people are to the Apple brand.

Back in April, Apple had a bit of a PR problem when it was discovered that iPhones were storing a cache of data on which GPS locations that handset had visited in an unencrypted file. The whole thing was just a bug, but the controversy was dubbed LocationGate, and Apple even had to testify in front of the Senate about the matter.

The whole fiasco even prompted an email from Steve Jobs, which dropped something of a bombshell: he said Apple doesn’t track anyone’s location, but that Android tracked everyone.

At the time, there wasn’t a lot of proof to back up Steve’s assertion, but as it often does, time has proven Steve Jobs right. Android phones do track you. In fact, software that comes pre-installed on millions of Android, BlackBerry and Nokia phones log everything you do with your device, and sends them off secretly to its own servers.

An Australian court has lifted the ban placed on the Samsung Galaxy Tab 10.1 allowing the Korean company to sell its Android-powered iPad rival down under. However, it had better start shifting them quick, because Apple is preparing to appeal the decision to the High Court.

The U.S. Government isn’t exactly known for smart spending, but at least that $10,000 hammer actually works. That’s more than the Department of Labor can say after they blew almost $200,000 on an utterly crappy app for the iPhone and Android.

The company making ‘Gorilla Glass,’ the tough material used by iPhones and iPads, today announced a 25 percent drop in sales due to lower demand for tablets. Corning cut its outlook after saying it will increase LCD glass production by just 5% to 10% instead of the expected 20% or more.

Research in Motion — roundly clobbered in the smartphone and tablet market — is now trying to hang onto its core enterprise customers. It’s formula is to concede defeat by Apple and Android, then sell its rivals’ victory as a reason to stay with the Waterloo, Ont. company.

While Samsung itself is quick to take Apple’s innovation and pass it off as its own, resulting in a number of lawsuits, the Korean electronics giant is still happy to mock the device that inspires many of its Android-powered smartphones. In a new TV commercial for its popular Galaxy S II handset, Samsung pokes fun at the iPhone and its devoted fans who wait in line for hours to pick up the device on launch day.

I think someone’s a little jealous that they don’t see endless queues when they churn out a new product.

Described as an “explosive development in the tablet market,” the holiday season could finally see a two-way race for consumers’ attention as the iPad and Amazon’s Kindle Fire vie for nearly 90 percent of sales. In a survey of North Americans intending to buy a tablet, 65 percent said they plan to buy an iPad, while 22 percent said they would pick the Kindle Fire, according to ChangeWave Research results released Monday. Those percentages may look disparate, but the Kindle Fire is still proving to be a shot across the bow of iPad… and it could soon become a full broadside.

The folks at Canlys this morning are doing what analysts are fond of: playing the ‘if’ game. If iPads were included in the same category as computers, Apple might soon overtake HP as the world’s largest PC maker — particularly if the Cupertino, Calif. company launches the iPad 3, anticipated by many to be a 2012 release. Canalys, which does count tablets as PCs, expects Apple to pass HP before mid-2012.

Apple has a long history of taking a technology created by Xerox and transforming it into the heart and soul of computing, such as the mouse or the concept of a graphic user interface. Now comes word Apple owns a Xerox patent for location based services. The patent could prompt Apple to sue a wide array of companies, ranging from Android-backer Google to social networking giant Facebook and any others relying on the ability to check users’ location.

A new study contains more evidence the iPhone is taking hold at work, even displacing the stolid business-centric BlackBerry as the smartphone of choice. Of enterprise workers carrying a smartphone, 45 percent said the handset is an iPhone versus 32 percent for the BlackBerry.

Research giant Gartner had a quick lesson for Apple: don’t let off the iPhone accelerator — if you do, you’ll pay. The latest price for delaying until October its new smartphone: iOS dipped to 15 percent of sales while Android-based handsets skyrocketed to 52.5 percent of the market.

A Wall Street analyst now says 26 percent of people considering buying the Fire are putting on hold purchasing the Cupertino, Calif. tech giant’s tablet. What’s more, consumers are more likely to buy the Amazon tablet than the iPad.
