The Samsung vs. Apple patent war has been raging for years now, but it took an interesting twist recently when a three-judge panel in federal appeals court reversed a $120 million jury verdict in favor of Apple.
The reason it’s interesting? Because, according to Apple at least, doing so was a violation of the U.S. Constitution.
In a petition for a re-hearing filed with the U.S. Court of Appeals this week, Apple’s attorney William Lee argued that the panel used materials that it researched itself and were not part of the trial court record. The panel had ruled that Samsung didn’t infringe on one of the three patents in the case, and stated that the other two patents were invalid.
Lee claims that this undermined Apple’s Seventh Amendment right to have a jury, and not an appellate court, decide the facts of the case.
Next step, the Supreme Court? It wouldn’t be the first time…
