Apple, Others Hit with Wireless E-mail Lawsuit

Emboldened by a $612.5 million settlement from Research in Motion, a company claiming to have invented wireless e-mail, Friday sued Apple, Google, Microsoft and three other handset makers. NTP Incorporated alleges the companies are violating eight patents on wireless e-mail.

The lawsuit, filed in U.S. District Court in Eastern Virginia, is aimed at getting Apple and others to pay licensing fees. In a news release, NTP said the defendants all make hardware or software to deliver e-mail via wireless communications.

Apple Remains #2 Smartphone Maker, But Android Gaining Ground

Although there are five names on the list of smartphone makers, most eyes are on just two: Apple and Google. While Apple retains its second-place position with 25.4 percent of the market, the Cupertino, Calif. company’s share fell 1 percent between February and May, according to comScore. Meanwhile, Android-based handsets grew from 9 percent of the smartphone market to 13 percent over the same period, a 45 percent jump, the analysts said.

Most of Android’s growth is coming at the expense of other smartphone brands, such as RIM, Microsoft and Palm, all reporting negative growth. Microsoft’s share slipped as partners await an expected fall introduction of the Windows 7 platform. Palm also fell amid its acquisition by HP.

Apple and Google have battled back and forth with competing product releases. Apple announced selling 1.7 million iPhone 4s in the first three days of availability in June. Meanwhile, Google announced last month 160,000 Droid x handsets were activated daily, compared to 100,000 per day in May.

Although Google hopes to grab a few more RIM users by upcoming Blackberry-like products from Samsung and Motorola, the Mountain View, Calif. company still has a long hill to climb. The market-leading RIM has 41.7 percent of the smartphone market, according to comScore.

Fortune: Steve Jobs ‘Smartest CEO’

Apple CEO Steve Jobs was named “Smartest CEO in Tech” by Fortune Magazine. Jobs bested Amazon.com CEO Jeff Bezos in a list of the 50 smartest people in technology. Jobs was described as a “visionary, micromanager, and a showman who creates such anticipation around new products that there releases are veritable holidays,” according to the publication.

Also named were Dendreon’s Mitch Gold, Alibaba’s Jack Ma and Demand Media’s Richard Rosenblatt.

Japan’s Softbank Uses iPhone to Beat Rivals

Japan’s third-ranked mobile carrier Softbank reported Wednesday it had 229,500 cell phone subscribers in June, topping the country’s biggest carrier NTT DoCoMo Inc., which recorded 164,000. Second-ranked KDDI Corp. had just 61,300 new subscribers. Softbank is the exclusive iPhone provider in a country where nearly three out of four smartphones are made by Apple.

In April, Softbank’s head, Masayoshi Son, said “the iPhone is selling so well that we are really feeling a boost from it.”Apple sold 1.7 million iPhones in Japan, 72 percent of all smartphones in that country. Indeed, the iPhone is credited with doubling the smartphone segment over 2009, according to the Wall Street Journal.

Could Apple Sell 25M iPads Next Year?

Predicting sales of a new product based on demand from eager early adopters can be risky. However, one analyst made such a leap. Bernstein Research analyst Tom Sacconaghi told investors Thursday Apple could sell 25 million iPads in 2011. But, then again, it might sell 18 million tablets next year. It kind of depends, you know?

“An analysis based on extrapolating sales trajectories of [the iPhone, iPod and all netbooks] suggests that Apple could sell a staggering 25 million iPads or more in fiscal 2011,” the analyst wrote. This seems to go along with Apple reporting selling three million iPads in the first 80 days.

Inside Apple’s New Shanghai Store

Apple’s Shaghai China store opens Saturday. With the impending opening comes comparisons with the Cupertino, Calif. company’s New York City flagship. Yep, the same glass cylinder, the same hoopla, the same moat. Moat?

Yes, along with a 40-foot high glass cylinder (with possibly the largest glass panes in the world) is a moat filled with water. While Apple Senior Vice President of Retail Ron Johnson wanted to focus on the “stunning architecture,” the site Shanghaiist wanted to talk about that moat. “There is an inexplicably shallow moat of water surrounding the store, tripping up those who don’t watch their step,” a writer comments. We aren’t sure about that architecture feature, ourselves. Could it be a concession to China’s government leaders, perhaps a way to track potential troublemakers; look for the wet socks?

Apple Unveils Shanghai Store

Although we’ve heard talk of Apple’s plans to open 25 stores in China over the next two years, here’s proof: workers taking the wraps off a store built in Shaghai.

In April, Apple told investment analysts the company was ‘well pleased’ by its initial steps into the China market. Chief financial officer Tim Cook said iPhone sales were up 200 percent during the first half of 2009. Apple added 800 more distribution points and saw iPhone sales increased 9-fold to 2.1 million units.

Analyst Lowers Third Quarter iPhone Sales, Raises iPad Expectations

Are Wall Street analysts being too aggressive expecting Apple to report 8.5 million iPhones sold during the fiscal third quarter? One believes so, suggesting to investors they wait until the fourth quarter for real gangbuster sales figures. Indeed, Kaufman Brothers’ Shaw Wu cut his third quarter iPhone sales projection by 1.5 million units.

“We are shifting our iPhone assumptions to latter quaters due to the high likelihood that an inventory drawdown and screen supply constraints could impact near-term shipments over the next two quarters,” he wrote in a Tuesday note. We believes “most Street estimates have not factored this in and thus we believe consensus at 8.5 million iPhones for the June quarter may likely prove too aggressive.”

Remember all the talk a few months ago whether the iPad would hurt sales of the iPod touch? That fear was overblown, according to one prominent analyst who Tuesday described the impact as ‘minimal.’

Additionally, despite early talk the iPad was selling better than Macs, Piper Jaffray’s Gene Munster expects the Cupertino, Calif. firm will sell more computers than Wall Street predicts. Indeed, Mac sales were up 37 percent for the first two months of Apple’s third-quarter, the period when iPads first went on sale.

Apple Allowing Google Targeted Ads — For Now

Although Apple unveiled new privacy rules with the iPhone 4 software for developers, the restrictions on data collection reportedly hasn’t prevented Google from serving ads within iPhone or iPad applications. A central reason why Apple is turning a blind eye to the third-party ads is to take FTC pressure off of the Cupertino, Calif. company, according to a Friday Wall Street Journal report.

The report quotes a developer for Conde Naste Publications that hesitates to test Apple’s willingness to enforce the new rules because iAds is the most lucrative advertising network.

Report: Apple May Create Standalone TV Product

Despite Apple CEO Steve Jobs’ 2008 statement that “no one has succeeded” in combining the internet, movies and tv into one living-room gadget, the Cupertino, Calif. company reportedly is revamping its AppleTV software and hiring broadcast design experts for what could be a new product based on the iOS operating system running the iPhone, iPad and iPod touch.

According to the New York Times, much of the new work is being done outside the Apple TV area and in a new design group, a move that “could signal an entirely new product.”

Apple: Jobs’ Email Exchange Was a Fake

Apple Friday “emphatically denied” an emailed statement attributed to CEO Steve Jobs and quickly spread by bloggers. In an exchange over frustration with iPhone 4 reception, the head of Apple supposedly replied: “It is just a phone. Not worth it.”

The exchange, originally published by the well-known Boy Genius Report blog, then spread by dozens of other sites, supposedly included this conversation between Jobs and a blogger identified as “Tom”:

  • Jobs: “No, you are getting all worked up over a few rumors. Calm down.”
  • Jobs: “You are most likely in an area with very low signal strength.”
  • Jobs: “You may be working from bad data. Not your fault. Stay tuned. We are working on it.”
  • Jobs: “Retire, relax, enjoy your family. It is just a phone. Not worth it.”

    Analyst: Verizon iPhone Won’t Appear Until Second Half of 2011

    Readers deserve to feel a bit like a ping pong ball as analysts swing back and forth on the question of whether or when Verizon Wireless will get the iPhone. What was once thought to be a moot issue gained new life earlier this week after a report suggested Apple would award the iPhone to Verizon in January 2011. Now comes an analyst who spoke with AT&T and says Verizon Wireless customers will have to wait until the second half of next year.

    Oppenheimer analyst Timothy Horan made the statement to investors Thursday after what he terms an “upbeat” talk with AT&T chief financial officer Rick Lindner. “The company gave some solid reasons as to why the iPhone will not affect its financial results all that much, but also why Verizon is unlikely to get [the handset] until the second half of 2011 or later,” he wrote.

    Report: iPads Invading the Corporate Boardroom

    If the Palm Pilot was the corporate digital tool of choice in 2000, today’s boardrooms are likely to be populated with iPads, according to one venture capitalist. “In nearly every board meeting I attend, multiple iPads are unfurled,” writes David Hornik of August Capital.

    Writing at VentureBlog, Hornik remarks about the button-down set: “Where once they carried Palm Pilots, now they hold an iPad under their arm. iPad is the new cool toy.”

    AdMob: 57 Percent of Known iOS Devices Outside the U.S.

    More than half of all iOS devices detected in May were located outside the U.S., a just-released survey indicates. Apple was also the most-frequent brand found, with 44 million unique devices, according to the AdMob ad agency.

    According to AdMob, 57 percent of the iOS devices it found in May were outside the United States. Although 48 percent of iOS devices, such as the iPhone, iPod touch and iPad, were found inside North America, 28 percent were from Western Europe, while 15 percent came from Asia.

    Report: Apple Hiring iPad, iPhone Antenna Experts

    As Apple CEO Steve Jobs furiously sent emails trying to knock down reports of antenna problems with the iPhone 4, the Cupertino, Calif. company apparently was busy looking for antenna experts. And little wonder the sense of urgency: the iPhone 4 could comprise half of the iPhones the company sells this year, according to a Wednesday report.

    A day before the YouTube videos appeared of dropped calls due to holding the iPhone a certain way, Apple posted job notices seeking iPad and iPhone antenna engineers with at least 10 years experience. The engineers’ job is to “optimize the radiation performance for mobile devices,” according to the posting.

    Analyst: Verizon Could Sell 12M iPhones — But Hold the Champagne

    One analyst warned investors Wednesday an unconfirmed report that Verizon Wireless will get the iPhone in January 2011, may be just more dead-end speculation. “Similar speculation has emerged before, so barring independent confirmation or a press release from one of the parties, it’d be rash to pop the champagne,” Oppenheimer’s Yair Reiner wrote.

    Although the idea of Verizon gaining the iPhone makes many analysts salivate at the prospect, so far it has only been a parlor game. Apple has defended the exclusive U.S. carrier in the past, and AT&T has recently taken steps to improve its 3G service.
