The ability to jump into iTunes and download practically any major motion picture ever created is just one of the many reasons why the iPhone and iPad have become so successful, but a Florida lawyer claims Apple’s HD video rentals are actually a scam.

According to a class action lawsuit filed this June by Scott Weiselberg at the San Francisco federal court, Apple may have violated consumer production laws and deceived customers into paying $1 more for HD videos by serving up HD versions of iTunes video rentals on iOS devices that don’t support HD video.

Rolomotion Brings Wii-Style Tennis To The Apple TV With New iPhone App

Back in April, we told you about Rolomotion, a new gaming platform for iOS that leverages the iPhone’s hardware sensors to create a Wii-like gaming experience on the Apple TV. Developed by Rolocule Games, the first Rolomotion game is available in the App Store, and it’s called Motion Tennis.

As the name implies, it’s a tennis game that requires an iPhone and Apple TV. Unlike most iOS games, the iPhone acts as a motion-aware controller. While it’s certainly not as polished as playing Wii Sports, Rolomotion is forecasting the future of Apple TV gaming.

Apple has today kicked off its annual Back to School promotion through the Apple online store. As it did in 2012, the Cupertino company is offering a $100 App Store gift card with every new Mac, or a $50 card with a new iPad.

This year’s promotion also includes the iPhone, which now comes with a $50 gift card, too.

Apple Reseller Offering Free Upgrade To iOS 7 Beta With iPhone 5 Purchase

Apple resellers in China and India will try almost anything to get people to buy an iPhone but one premium reseller in India is taking it to an all-new level by offering customers a free upgrade to the iOS 7 beta with the purchase of an iPhone 5.

Don’t want to have to buy a new iPhone 5 just to play with iOS 7? The store says they’ll also let you pay to just upgrade to the iOS 7 beta for $20 if you have an iPhone 5 but it’ll cost you $23 for an iPad.

iOS 7 is in its second round of beta testing with developers and won’t be released until Fall 2013. The reseller’s Facebook posts advertising the promo have already been taken down, so we wouldn’t be surprised if Apple already put the kibosh on iCentre India’s new marketing strategies.

Apple Maintains Lead Over Samsung As Top U.S. Smartphone OEM

Apple is stil the top smartphone maker in the U.S. according to the latest quarterly report from comScore. While HTC, Motorola, and LTG continued to lose marketshare in the U.S. over the last three months, Apple and Samsung have continued to outpace the competition.

As of May 2013, comScore found that the iPhone now accounts for 39.2% of the U.S. smartphone marketshare. Even though Apple has the lead in hardware, Android is still the top ranking smartphone platform in the U.S. with 52.4 percent market share.

Apple is reportedly reducing its iPhone orders for the remainder of 2013, according to supply chain checks carried out by analyst Peter Misek. Orders for July-September has been significantly slashed from 40-45 million units to 25-30 million units, while Apple’s holiday quarter build plans have fallen from 55-60 million units to 50-55 million units.
