This Single Image Sums Up The Apple vs Samsung Legal Debacle

The entire legal battle between Samsung and Apple is just crazy enough to make your head spin if you even care. One day Apple’s got Samsung’s new Android phone banned in the US. The next, they have to issue a statement that Samsung didn’t copy them.

The whole episode is kind of silly, but Apple has a very strong argument that Samsung’s smartphone lineup is just a rip-off of the iPhone. Case-in-point, the image above was made by All Things D’s John Paczkowski to show Apple’s main argument in the legal battle: Before the iPhone Samsung phones had variety and looked nothing like the iPhone. After the iPhone they all look just like the iPhone.

    looks like before the iPhone samsung was copying blackberry… then jumped on the apple bandwagon like every other smartphone manufacturer.

    Hmm…. looks very… erm…. selectively done. Remember that all of the phones on the left arrived before touch screens existed in a small enough form factor to go on an affordable phone. All of the phones on the left were non-touch, and made in a time when the coolest most expensive phones were PDA’s, which incidentally all shared the same form factor too. I love my Mac and my iStuff, but I think if you look back in history you’ll find that nobody has ever sued someone for a form factor in history and I think its unfair that Apple has.

    Looking a little deeper into this, Samsung have provided a ton of parts for the iPhone, and have been sued in the past over the F700 phone by Apple. If the design had really been stolen, this would not be a patent case, it would be corporate espionage as Samsung would have know the design before the release of the iPhone due to the contracts it already had in place with Samsung.

    I think Apple stole their design of the iPhone from a burnt Pop-Tart I fished out of the toaster one morning. I think Tim Cook owes Kelloggs a BIG apology AND a few billion is recompense (minus my 15% fee of course).

    The Samsung Blackjack, it was like a skinnier sexier blackberry. But thats like saying its better looking than the ugly tree. Yeah look where RIM is now, not that I think Apple will fail miserably like they have, it is in their best interest to protect their products and image.

    Some of the fandroid arguments remind me of the reasoning of global warming skeptics or that of creationists (against patterns in the theory of evolution). They are constantly bringing up the marginal while ignoring the obvious.

    I think Apple and other smartphone makers all stole some ideas from each other but then that’s how mankind advances himself
