Samsung pleads for damages cut in patent war with Apple

Samsung is asking the U.S. Court of Appeals for the Federal Circuit to cut more money off the $930 million Apple won in a patent lawsuit. The company is arguing that the appeals court’s earlier ruling is still unfair, even after successfully convincing the panel to chop off $382 million already.

Samsung is now asking for a reduction of  $399 million from the total bill, which is the total amount in profits from products that the court ruled infringe on Apple’s design patents. Apple was originally awarded $930 million in 2012, but after Samsung’s appeals were complete, the award dropped down to $548 million. If Samsung is successful Apple’s award could shrink to just $149 million.

“Unlike rugs, spoons, and simple mechanical objects, smartphones incorporate hundreds or thousands of different patented technologies, and it is undisputed here that Apple’s design patents claim only partial, minor features of such devices and that some attributes of those designs are functional,” wrote Samsung’s lawyers.

Samsung requested all judges of the court to review the decision made by the three-person panel in this legal battle that appears to still have no end in sight.

The court ruled pretty clearly in 2012 that Apple should receive ALL the profits from the products that infringe on the patents. Not just profits specific to the individual design parts. Asking for a complete reversal on that ruling could be a tough sell on Samsung’s part.
