Report: Apple To Pay $22M To Settle ‘Scratched Nano’ Lawsuit

Owners of 2005 nanos may receive a settlement from Apple.
Consumers who purchased the original nano introduced in 2005 could receive $25 as part of an agreement yet to be signed by the court, CNBC reports.
“Apple has agreed to provide a cash settlement of $22.5 million,” the Cupertino, Calif.-based company told nano owners this week. A $25 refund will be given to nano owners who purchased the digital music player without a “slip case,” designed to prevent the screens of early nanos from scratching.
Owners of first-generation nanos that were provided a “scratch case” are eligible for a $15 refund, according to Apple.
The settlement stems from an October 2005 class-action lawsuit filed by nano owner Jason Tomczak. Tomczak and others filed legal action after discovering some earlier units suffered “excessive scratching” after Apple allegedly failed to provide “coating” to prevent marred screens.
A court has yet to sign-off on the agreement. An April 28 hearing is set.
Tomczak’s lawyers will receive $4.5 million to cover legal fees, according to CNBC’s Jim Goldman.
