3G Owner Sues Apple for Making a “Defective Product”

An Alabama iPhone 3G owner filed suit in Federal court yesterday, seeking class action status in a complaint against Apple’s ‘twice as fast at half the price’ marketing blitz.
The petition claims “[Apple] expressly warranted that the Defective iPhone 3G would be ‘twice as fast’ and would otherwise perform adequately on the 3G standard or protocol.” The plaintiff claims she and a class of “thousands, perhaps tens of thousands” of consumers were duped by the company’s marketing into buying a product that does not perform as it was advertised and asked the court to force Apple to repair or replace the iPhone 3G, and award an unspecified amount of money in damages.
Apple has yet to issue a statement or response to the suit.

If this goes through I’m suing Pringles for telling me that “Once you pop the fun don’t stop”. Because believe me people, I popped it, and the fun stopped.

what I wonder is if she actually tried to take the phone back to a store to complain about the performance she was getting and what did they say. cause at my local store I’ve seen them swap phones that probably weren’t really broken at all to keep the customer happy. did she go in and talk to someone. and is the 3g coverage in her area really that awesome. also, how many apps did she load on the phone. and which ones. cause a faulty app can mess with your phone. I had that issue a couple of times already. sounds to me more like she just doesn’t like the phone but doesn’t want to return it or perhaps can’t cause she’s past the return period and she’ll be hosed with open box and ETF fees
