Apple has added the Samsung Galaxy Note 10.1 and the software that powers it, Android 4.1 Jelly Bean, to an existing lawsuit against Samsung in California. The Cupertino company told U.S. Magistrate Judge Paul S. Grewel on Tuesday that both are guilty of infringing patents owned by Apple.
Bloomberg reports that in addition to this, Apple attorney Andrew Liao told Grewel that the Samsung Galaxy Nexus is the only smartphone with Jelly Bean that Apple wants to add to the complaint, along with 17 other devices that could be used with a stylus — even though not all of them may ship with one.
Apple’s efforts to expand the lawsuit follows Samsung’s decision to add patent-infringement claims against the iPhone 5 to the same case back in October. Victoria Maroulis, an attorney for Samsung, told Grewel that Apple’s new smartphone is the only device it is targeting.
Maroulis also opposed the addition of “stylus products in 17 new devices,” and said that “by adding the stylus, Apple is going to enlarge the case significantly.”
Grewel chose not to issue a ruling on Tuesday. Bloomberg reports that Grewel was worried that if he dismissed both sides their requests, then they may file yet another new round of lawsuits against each other.
Apple’s complaint against the Galaxy Note 10.1 and Android 4.1 Jelly Bean is now scheduled for trial in 2014.
As for the previous case between these two companies, which saw Samsung fined more than $1 billion for infringing six Apple patents, Judge Lucy Koh has scheduled December hearings for the appeals. She will also consider Samsung’s bid to get the August verdict thrown out based on claims of juror misconduct, Bloomberg reports.
