Apple vs. Samsung IP Smackdown: Court Grants EU Galaxy Injunction

It looks like Apple may have won round two in the global fight against Samsung in the tablet turf wars.

German news agency DPA just reported that Apple has been granted a preliminary injunction against Samsung’s Android-based Galaxy Tab 10.1.

Distribution of what Apple called a copycat computer is now verboten in the entire European Union-27 (except for the Netherlands, which may have its own suit) Fosspatents says.

It’s the second hit to Samsung, which lost a similar case August 1 in Australia and makes news just as one analyst predicts that Apple faced serious competition in the Eurozone over tablets.

The prelim injunction is all about the design — which if you take a look at the certificate of registration of the enforced intellectual property right from Apple looks pretty much like any small, flat-screen computer, the very definition of “tablet.”

    The best that can come out of this is Samsung stopping overtly copying Apple. I don’t want anybody’s products getting banned. Just stop ripping off in the future, ok?

    I love Apple, but that is downright cruel.  The Galaxy Tab doesn’t look too alike to the iPad.  I am very mad at you, Apple.

    I’m a big Apple fan, but I have issues with this suit. There are only so many things you can do with the physical form factor of a tablet. If Apple has issues with the OS then go after Google. On the iPad and Galaxy the hardware internals are different, the button layouts are similar (but still different, no physical buttons on the front of the Galaxy). You can only make a 10″ tablet in so many shapes.

    it doesn’t look too alike? it shouldn’t look alike at all, samsung is trying to feed off apple success. look at the galaxy s phones and tabs.

    I think there is a lot you can do with tablets.
    Look at the HTC Flyer and the Acer Iconia tablets, it’s possible to make a very unique looking tablet. Samsung new Galaxy Tabs on the other hand is strikingly similar, even uses a very similar dock connector instead of the (in the android world) standardized micro usb…

    I am with them and say it’s very similar looking, Samsung even went with a 30 pin dock connector instead of a micro USB that is usually used on android devices.

    Look, I have both an iPhone, an iPad and the older 7 inch Galaxy Tab, and my main computer run Windows. I am not with Apple on this because of being a fanboy, it should be pretty clear for most people where they are coming from in this case, and it seems the courts agree with them.

    Sorry to burst your bubble, but injuctions have nothing to do what court thinks. It is to limit potential damages to Apple. If Apple will loose case they will open themselves up to huge damages suit from Samsung. It is very risky move and is synchronised action indicates that Apple is desperate and tries to boost their sales trough cutting out competition.
